Secretary of Transportation Rodney Slater has announced that FMCSA will begin
using the shutdown powers granted FMCSA under TEA 21.
In short FMCSA will begin issuing orders, to carriers who receive
unsatisfactory safety ratings, to cease operations 61 days after the unsatisfactory
rating is assigned.
In the past FMCSA has only had and used this power to shutdown unsatisfactory
carriers who transport HazMat shipments. Under this provision FMCSA can shut
down a carrier transporting HazMat shipments on the 46th day after the
unsatisfactory rating is issued.
The expanded shutdown powers will not be applied retroactively so if you
received an unsatisfactory rating prior to the FMCSA invoking these powers you
will not be shut down. However, if you have a current unsatisfactory safety
rating and FMCSA conducts a follow-up Compliance Review which yields an
unsatisfactory rating, you will be subject to the shutdown order.
