A
bill has been introduced in the US Senate which would prohibit the FMCSA from
adopting the Hours-of-Service proposal which they introduced last year. Senator
James Inhofe (R-Oklahoma), who is the Chairman of the Senate Transportation and
Infrastructure Subcommittee, introduced the legislation which would prohibit
FMCSA from using any funds to "finalize, implement or enforce" the
proposed Hours-of-Service regulation which was proposed in April of 2000 by then
Secretary of Transportation, Rodney Slater. A similar bill has
been introduced in the US House by Rep Lee Terry ( R-Nebraska) and is expected
to be referred to the House Transportation and Infrastructure Committee, chaired
by Rep Don Young (R-Alaska). Inhofe's Senate bill is expected to be referred to
the Senate Commerce, Science and Transportation Committee which is chaired by
Senator John McCain (R-Arizona). The FMCSA received huge criticism
and over 70,000 comments to the proposed HOS regulation. They were halted by
Congress from implementing the proposed regulation until October 2001, but were
allowed to continue research on the proposed regulation. If
passed, the Congressional action would end the possibility of this regulation
being implemented. If not the FMCSA is technically able to move forward with the
implementation of the regulation after October 1, 2001. Read
