FMCSA
has left no doubt that they are serious about cleaning up the acts of bad
carriers. In the past FMCSA has assessed only a portion of the fines it is
allowed too under law. Well, no more... Carriers who have had
enforcement actions taken against them over the last 6 years may be in for a big
surprise. FMCSA announced they will assess the maximum penalties allowed, for
carriers who have had enforcement actions taken against them for the 3rd time in
6 years, for the same violations. FMCSA is talking heavy-duty money now.
A carrier with a history of hours-of-service violation enforcements could see a
fine of $10,000 per violation. To a carrier with 40 violations this could amount
to a whopping $400,000. FMCSA is tired of going back to the same carriers over
and over and citing them for the same violations. This new message will
definitely get their point across. What part of "Don't do That"
don't you understand?
