FMCSA is wasting no time in
using its new teeth to punish motor carriers who do not comply with the
regulations.
Two
officers of a Pennsylvania trucking company have been personally fined,
given prison sentences and barred from working in the trucking industry
for three years because of Hours-of-Service violations. These personal
penalties are in addition the the $50,000 the company was fined for the
violations. FMCSA has given the entire industry plenty of warning that
they will pursue personal criminal prosecution of company executives for
FMCSR violations when appropriate. This is not the first case of
criminal prosecution of trucking company executives and certainly won't
be the last.
In related news two Washington state carriers were
shut down when the FMCSA issued Operational Out-of-Service Orders for
both carriers. The state of Washington then immediately revoked the
registrations of all of their vehicles.
The FMCSA is serious about enforcement and their
latest actions reinforce their "take no prisoners" approach.
FMCSR compliance is no longer just an issue of
potential fines. It's now an issue of whether or not you can remain in
business and even if you may go to prison. Neither of these
possibilities are acceptable...................
