FMCSA
has rejected all petitions for exemption from or change to the new
Hours-of-Service regulations.
Although there is still an outstanding federal court action
regarding the regulation, this action probably won't affect the January 4th,
2004 implementation of the regulation. If successful the action may mean
reverting back to the old rules sometime in the spring or summer of 2004.
Bottom Line? Prepare to begin using the new HOS rules
as of January 4, 2004.
What do you need to do?

Learn the ins and outs of the new regulations.

Assess how the new rules will affect your operation and
what operational changes you will have to make in order to best utilize
driver hours.

Train your managers, supervisors and dispatchers how to
effectively use the new rules.

Train your auditing personnel how to monitor violations
under the new rules.
The new rules have some good elements and some bad elements
depending on your particular operation. One thing is certain however, they will
pose a challenge to everyone regulated by them.
Don't wait until January 3rd, 2004 hoping the new rules will
go away! It doesn't look like they will. Prepare yourself now and be ready to to
make a painless switch...
